I wouldn't bet on the dealership giving you a better deal.... my old car which was replaced in March of this year due to faults is still sat on the forecourt.... Its 03 reg with only 5000 miles on clock and i thinks its up for £8k....

That is partly why refund agreed...but just before this they almost accused me of not permitting them access to the car to carry out repair which was balderdash.... The day they were contacting CUK to go for the refund they almost hit me with this again by saying you sure you dont want us to try to fix it again...quickthinking, i didn't want this to be seen as the above so said i want a refund but in the meantime the car does need looking at...so it went back in for a 4th time and will not be going in for 5th time next week!! Seeing as its been a month now I'm glad it has been going back cos i dont want to drive with wet rear!!

in response to last couple of posts.... Ian - they almost tried a get out clause with me by saying I refused them to attempt a repair but I wasn't having that as I didn't want them coming back to me and saying well you didn't let us try and fix it so we aren't going to help you....besides its now been 3 weeks and I dont want a wet rear while drving until its sorted.... I'm not getting another convertible....just going for standard 206 Zest....save me some money and pay for a holiday to get over the stress of Citroen! LOL 4 weeks tomorrow since I was told! I gave them 7 days from 22nd Oct to response other wise solicitors and national press are going to be brought in to push the refund.... Even tried calling HO and they wouldn't speak to me - I had to speak to dealership.... The GM from the dealership is now onto CUK....I believe they need authority from there to refund. Otherwise dont know why this has gone on soooo long as the After Sales Manager is 100% behind me.... :unsure: :unsure: Gar

Well it still never ceases to amaze me.... Its now been 3 weeks since I got a call to say I would be getting a refund and i have still not had anything concrete from CUK to confirm this or any indication as to when I will get the money back. To top things off the car was taken back in last week to have the seals looked at and they have done the same as what happened last time. The roof appears to have been pushed back a few millimetres which then allows air in and condensation to form right along the front of the roof which then happily drips onto you and the seats while driving and the whole interior of the car feels damp due to the moisture inside...... Back again it goes!!! :unsure:

Julie, you are legally entitled to a replacement car of the same model or another model of equal value or a full refund....dont let them tell you otherwise... See the legal jargon section for more info.... Gar :lol:

Well it has worked. Citroen have just agreed to give me a full refund. Will take a couple of weeks to sort out but I have had the verbal confirmation. Keep pressing them whoever else is still struggling and dont give up.... Use cases on here as examples...if they can do it for one...why not all.... Funny how folk jump through hoops when the media get involved. Citroen only really started working with me to get my first replacement when i threatened legal action and media involvement. Will update later when i get their decision!

Les, can i ask also how long it took from them saying you were getting refund to actually getting a cheque in your hand? Or have you got that far yet....? Gar.

like i say - quoting the law helps.... I will get a decision tomorrow as to whether I am getting a refund...but its nice to see another post on here with a sucessful refund. Hopefully tomorrow it will be bye bye Citroen....

Refer back to my posts in the legal jargon.... If you quote the law it puts them over a barrel and once they know that you know your rights and what you are entitled to they soon perk up.... Gar.

Fantastic to hear someone else got their money back!!! Victory! My request for a refund (see legal jargon topic) is being responded to tomorrow so I will update you all to see if I get what i wanted. Did you just get full refund or did you ask for any compensation too? I have asked for a bit of compensation to the value of the added extras I got as compensation with my replacement... Gar.

Dobbin, fortunately i have a few friends in solicitors firms....so has just been friendly help and advice and I have sent the letters quoting advice. check home insurance if you got it...some include free legal helpline and cover...but you need to show x amount of loss before they take on a case... but they have bucked up this time purely by quoting the law at them and pointing out I am totally within my rights and they can't back out. I have just sent ultimatum to them today prior to tomorrow's meeting requesting full refund + £500 compo for extra fittings or a replacement car with compo to equate the same deal... Will update after their meeting tomorrow. Just remember its standard practice that after 3 failed repairs you are entitled to your money back....

Well it worked! I got a phone call today within 24 hours of sending fax spouting all the right jargon..... They will be calling me back on Tues next once they have spoken to Citroen Rep to discuss replacement vehicle or the way ahead.... Here's hoping!

I would push to have them replaced. Others have had it done due to water staining from the leaks. Its the fault of the leaks so it should be covered under warranty for the garage to do this.

For all those leaky owners out there! I have just spoken to my solicitor and an ex dealership worker who both confirm the following..... 'according to your statuatory rights you must give the garage 3 attempts to repair the defects within a reasonable time (only a court would be able to decide what this would be!). If they are unable to resolve the problem after 3 attempts then regardless of garage/company policy, you can rely on your statuatory rights. There is an inherent defect and as such you can claim a full refund or replacement' How many dealerships have openly adhered to this?? I have just sent a statement to mine to that effect as my new 04 replacement also leaks and has been in 3 times for repair and they are being stubborn and saying the warranty does not give provision for replacement vehicles. Its not your warranty you are working from...its the Sales of Goods Act and your statuatory rights as a consumer....hammer that home....! Gar. Hopefully soon to be an ex Pluriel owner!

I was just informed last week that the CD Auto changers (if you have one) were faulty and needed upgrading, which they did with mine last week after it stopped working altogether. I dont know if a specific recall has been made, but if you have a CD Changer I would query it. Gar.

Interesting to find out for ammunition against dealers to say, Look out of x amount of leaking cars y% could not be repaired. From reading on here, I dont think anyone has had a resolve through warranty work. Replacement is the final straw for most and if like me...still not the answer. Gar.

:( :angry: :blink: :angry: Well the inevitable has happened today during light but prolonged rain....INGRESS through the new super duper car with its new super duper refitted seals..... Guess Ian you were right...not IF but WHEN it leaked! Just made my call to the dealership to inform them and they said lets book it in...I said no. I told the guy to get on to his manager who i wrote to last week to act on my letter which now comes into force. i.e. this time is the last time! I am now going to attempt to get either my full £12k refund or a replacement car to the same value. Fingers, toes and everything crossed! Lets see if they are as good now as they were last year.... My reading of the DVLA description is that it would be classed as manual as you have the gear 'levers' on the steering column. So the dealer is right in saying its manual.

Ian...its going back to get windows looked at!! LOL (why am i laughing!!??) Dont think they are too high though...but i think they have pulled the whole doors in tighter and when raising the passenger side front window its struggling as its too tight to the rear one....(ho hum!)

My spies on the ground tell me there could be a solicitors in the country who are co-ordinating a group secondary legal battle with Citroen UK. Apparently this is possible. Your contract is with the dealer and that is who your legal battle would be with, but Critroen UK can be brought into as a secondary party. Might not be true....but my spies are sourcing for me and I will update you post haste!!! Gar

ok - reply on a couple of things....when i got my new car in March as replacement I signed something to say that the cashback would not come to me but the dealership....so check the purchase agreement carefully. I just thought fair enough...this is a replacement car after all. I did get one of those letters about discount but I assume they are just generated automatically on purchase processing. So I ignored it having signed a disclaimer. 2nd...just got my car back after the ultimatum last time fix - they say no leaks and they left a hose running at it for 2-3 hours and left it out in downpour yesterday. (by the way, and they told me this, Citroen DO NOT advise using hosepipes or jet wash against the seals! - but they did to rigorous test) But I can see some water sitting in the seals and I just know that after another shower or in a couple of weeks its going to start coming in again. At that point I heading for refund or new (different) replacement car to the value of original £12k. (got my eye on MoS C2!! souped up sound system!) I'll glad Claire you have been offered full refund and i will use your case... My dealership has been good to me granted....its just the car at fault....in fact the last 3 days while the car has been in (ok so they had a threatening letter last week!) they have called me every day to let me know what they are doing and did not have to fork out for the courtesey car as usual. Will keep you posted after the next rain shower...

Dobbin...could just be coincidence, but who knows....I am literally now sat typing a letter to the dealership to say that if they can't solve the problem this time then I am expecting a FULL refund of the £12,000 i paid just over a year ago or a replacement (different model) to that value. I've had it with the Pluriel....I love it, a cheap convertible thats fun an funky to drive....but I think the word that stands out there is 'cheap'.... It doesn't work....i wish now i had have invested a bit more and bought a 'proper' convertible. Will keep you posted!

I have sent the following e-mail to the watchdog reporter who did the story earlier this year.... Stuart, You dealt with this investigation earlier this year and spoke with myself, however, my part in the program was dropped as I had recevied a resolution in getting an exchange car. I received the exchange car at the end of March and to date it has been back to the dealership twice due to 'water ingress' through the arch seals. Both times the dealership have explained its the way I replace the arches, and fair enough, after them doing it in the workshop I experienced no leak until I had removed the arches and replaced them. Until now.... The arches have not been touched since the last time at the dealers and i have water ingress on one side where it usually occurs, but worse is a mini flood of water that soaked my passenger which came through another part of the roof arch where water had obviously built up and when i braked this flooded in...and has now just started dripping regardless... The car is booked in again on 16th Aug... There is obviously still an inherenet fault with these cars and any help Watchdog could give to owners to get their money back would be wonderful. The new improved seal on the 04 models seem to be better but not perfect. I know from our Pluriel forum a lot of folk are still waiting for replacements, but are not even more dubious after hearing what I have had to say... I am now of the opinion that I just want my money back and will be writing to the dealership to say such very shortly. I look forward to hearing from you to see if Watchdog will take up this continuing saga.
