Hi.

 

I've just bought a 2008 C5 (after owning a 2002 model for 5 years) from a Jaguar Dealership.

 

When I viewed the car it hadn't been prepped and there was a crease in the rear bumper. "Don't worry, we'll get that out, no problem" said the salesman, but now he's telling me on the phone they haven't managed to do it. I'm due to collect the car saturday, where do I stand/what should I do?

I am not a legal expert, but there is a verbal contract, even if not noted on the sales contract, so the repair should be done unless you agree otherwise. On BBC Watchdog last night there was a case involving a verbal contract and it was upheld.

 

If they insist on not doing the repair, they have broken their side of the contract so you should be able to agree a lower price or to decline the car and get your deposit back - I hope you have not paid the full amount yet. It may be worthwhile getting an idea of the cost of the repair to help negotiate a lower price - if they could not repair the existing bumper then a new/secondhand one is needed.
